Terms and Conditions

  • Price Quotation Helen Theron will provide the client with a written quotation for the requested artwork. This quotation includes the cost of materials, estimated hours of work and any additional charges that may apply. Prices are subject to change based on the complexity of the project but will be agreed upon before the commencement of work. 
  • Shipping Costs Helen Theron will provide a quotation based on the information provided by the client and the current courier costs based on the approximate size and weight of the artwork. These prices are subject to change and will only be finalised on completion of the artwork. The client is liable for the full cost of shipping. If the final cost of shipping exceeds the original shipping quote by 20% (twenty percent) the artist will cover the added percentage outstanding.
  • Mock Up Artwork During the initial discussions around the photo that will be used for your artwork, Helen Theron will provide you with a mock up artwork to give you a rough idea of how the final piece will be laid out. Once you, the client, and Helen Theron, the artist have agreed upon a layout and the colours for the piece etc, as seen in the final approved mock up, no changes to that  layout will be allowed. i.e. once the artist begins the work, no major changes will be made and the client will forfeit the non-refundable booking fee.
  • Changes to the Final Artwork Due to the nature of the surface that Helen Theron uses, it is extremely difficult to make any changes, in some cases, impossible. The artist will make all efforts to make minor changes were possible, but, there will be an added surcharge for each change. Change surcharges are separate to the original Price Quotation. If the Client has approved the artwork and it has been shipped to the Client, the Client has 7 (seven) days to notify the Artist in writing of any concerns. In the rare instance that an Artwork needs to be returned for alterations/changes, the Client is responsible for the shipping charges both ways.
  • Acceptance of the Commission  Acceptance of the commission must be made in writing (email or social media messenger are acceptable). By accepting the commission, the Client agrees to these terms and conditions
  • Booking Fee A non-refundable booking fee of 50% (fifty percent) of the total quoted price is required to secure the commission and begin work. This booking fee will be deducted from the final payment amount.
  • Photo Provision The client must provide high quality, clear photographs. If the photographs were not taken by the client, the client must disclose the name of the photographer so that the Artist can contact the photographer and request permission to use the image as a reference photo. If the photographer will not agree, a substitute photo will need to be used instead. The quality of the commissioned piece is directly related to the quality of the provided photographs. The Artist reserves the right to reject any photo that does not meet the necessary quality standards.
  • Copyright The artist retains full copyright to the commissioned artwork from the client’s photograph. The artist reserves the right to share on their social media and website, and may use images of the artwork in competitions.
  • Time Scale for Portrait The completion time for a commission varies and is dependent on the Artist’s current workload, the complexity of the commissioned piece, and the size of the artwork. An estimated completion date will be provided when the commission is accepted. However, this is an estimate and not a guarantee. The Artist will ensure they communicate regularly with the Client to keep them up to date with their commission.
  • Balance Payment The balance of the payment is due upon completion of the artwork, before shipping or delivery. The artwork will not be shipped or delivered until the final payment has been received. Payment is taken via Paypal, Direct Bank Transfer or online through this website, an invoice will be sent to the Client’s email address. If no final payment is made, the Artist will retain ownership of the commissioned artwork and may sell it to recoup costs if necessary.
  • Refund If the full payment has been made and the Client is unhappy with the final piece, the Artist will refund the balance amount but not the non-refundable booking fee. The Artist reserves the right to keep the final artwork and sell it to recoup costs if necessary.
  • Sharing on Social Media The Artist reserves the right to share the commissioned artwork on social media and for portfolio purposes. The Client is responsible for notifying the Artist if the commissioned piece is a gift and if the Artist needs to delay the sharing of the artwork on any of their social media channels.  
  • Termination of Commission Request The Client may terminate the commission request within 7 (seven) days of the initial deposit payment so long as the Artist has not already begun the artwork. If the Artist has begun the commission, the booking fee will not be refunded. If the Artist must cancel the commission due to unforeseen circumstances, the deposit will be fully refunded to the Client.
  • Gift Vouchers Gift vouchers are valid for 12 (twelve) months from the date of purchase and can be redeemed against any commission or item in my shop. Gift vouchers cannot be used in conjunction with other offers or sales. Gift Vouchers cannot be refunded or exchanged for cash.
  • Damage in Transit I take great care in the packaging of my product, however, in the unlikely event  of damage during transit, photos must be sent immediately upon receipt of the artwork. Photographs of the packaging before, and after opening, as well as photographs of the damaged products must be provided. Depending on the extent of the damage, and at the Artist’s discretion, the artwork must be returned to the Artist and she may redraw the piece at minimal or potentially no extra cost. The new portrait, if agreed upon, will be added to the commission waiting list and may not be completed immediately.
  • Lead Time I typically have a waiting list in place and lead time will depend on time of year and number of portraits booked ahead of you. Commissioned pieces are on  a first come first served basis. I will provide an estimated completion date during our initial consultation. Please also refer to Time Scale for Portrait above. I will try my best to accommodate any special date requests.
  • Prints Whilst all due care is taken to assure accuracy in colours for prints, the Artist cannot guarantee 100% that the colours will be identical. This is due to differences in screens, different Fine Art Printer settings etc
  • Import Duties All items for sale on this website, including commissioned portraits may be liable for Import Duties, Tariffs or other importation costs depending on the Country the artwork is being sent to. The Client has sole responsibility to pay any of these added costs as well as to educate themselves on potential costs for the destination country. The Artist is in no way responsible for any of these costs.
